UTi's web server recognizes and records certain non-personal information about users of this Website. Currently, this information may include the type of browser used, the type of operating system of your computer or other Internet access device, and the domain name or Internet Protocol ("IP") address of the visitor's Internet service provider, the number of users that access a specific page on this Website and the character and duration of such visits. In the future, we may collect other non-personal information through other technologies. Non-personal information is used only for internal review purposes such as tracking the total number of visitors to this Website on an aggregate, non-personally identifiable, basis. This information may be used to help analyze site traffic and improve our services. We may also aggregate such information to create statistical data and we may share that information with potential advertisers, partners, affiliates and other third parties.
We do not require persons who use and access this Website to register or provide information in order to view our home page or most content on this Website. However, in certain circumstances, you may be asked to register and provide us with some specific information about yourself in order to use or access certain features on this Website, such as personalized content, including, without limitation, interactive functions available on this Website; surveys and other promotions; to receive information from us in the future, such as newsletters and emails; or to fulfill a request or order. Such information may include contact information (such as your name, address, telephone number and e-mail address), as well as other information we may require to carry out certain features of this Website. We do not collect personally identifiable information from visitors to this Website unless it is provided to us voluntarily and knowingly.
The personally identifiable information you submit will be used: (i) to carry out your requests and respond to your inquiries, (ii) to provide or enhance the services we make available to our clients, (iii) to market and communicate with clients in relation to UTi's services that we think may be of interest to our clients, (iv) to perform market research and satisfying other legitimate business interests, (v) to comply with government regulations, and (vi) as otherwise disclosed at the point where such information is collected or in any additional terms and conditions applicable to the particular feature of this Website. To accomplish this, we may share your personally identifiable information with third parties that perform functions on our behalf (or on behalf of our partners) or who are assisting us in processing the information for the purposes listed above, but such information will be shared only to the extent these third parties need such information to perform their functions. It should be noted that, although we make reasonable efforts to prevent unauthorized persons from accessing our facilities and vehicles, we are not responsible for maintaining the privacy of personally identifiable information placed in plain view on a package.
Your personally identifiable information (except any credit card information provided) may also be used by us or shared with our subsidiaries and affiliates. However, you will always have the opportunity to instruct us not to share your information with UTi's affiliates by contacting us at the address listed below.
Consent to receive e-mails
We may mail, e-mail, telephone, or contact you by other means to notify you of new services, or enhancements, or other relevant information that may be of interest to you. You may also receive mailings or other communications from carefully selected third parties. We always offer you the option to decline any or all of these communications by following the directions included in our e-mails or other communications, or by contacting UTi directly.
In some cases your permission will be implied from the nature of the service requested or transaction undertaken. For instance, UTi may collect and use personally identifiable information that you volunteer, or behavioral data or information collected in the aggregate. In addition, your permission will be deemed given for communications from us that are necessary to fulfill transactions and services that you request.
We reserve the right to disclose any personally identifiable or non-personally identifiable information if we are required to do so by law or if we reasonably believe that such action is necessary in order to: (i) fulfill a government request; (ii) conform with the requirements of the law or to comply with legal process served on us; (iii) protect or defend the legal rights or property of UTi, its affiliates, this Website or its clients or other users; or (iv) in an emergency to protect the health, safety or property of an individual.
Retention of information
UTi retains information, including personally identifiable information, about clients and visitors to this Website as necessary for business purposes and as required by law or other government regulation. For instance, we retain information about shipments, including names and addresses, so that we can provide proof of delivery and to process claims requests. We use reasonable efforts to carefully dispose of records and delete information when applicable retention periods expire or when such information is no longer needed to satisfy business purposes.
Keeping your information secure
To prevent unauthorized access or disclosure, maintain data accuracy, and ensure the appropriate use of personally identifiable information, we have put in place reasonable physical, electronic, and managerial procedures to safeguard and secure the information we collect on this Website. However, we cannot guarantee or warranty the security of the information you transmit to us electronically through this Website and cannot be responsible for the theft, destruction, or inadvertent disclosure of your information.
As UTi continues to develop its business, we may sell or purchase assets, including subsidiaries and business units. If another entity acquires us, any of our subsidiaries or any of our business units, information that we have collected about the users of this Website, including, without limitation, personally identifiable information, may be transferred to such acquiring entity as one of the transferred assets. Further, in the event a bankruptcy proceeding or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties in connection with any such proceeding. You acknowledge that such transfers may occur, and that any such acquiring entity may continue to use your information as set forth in this policy.
