UTi Worldwide wants to focus your attention on the Public Health
Security and Bioterrorism Preparedness and Response Act of 2002
(the Bioterrorism Act). This act requires domestic and foreign
facilities that manufacture, process, pack, or hold food for human
or animal consumption in the United States to register with the
United States Food and Drug Administration (FDA) by December 12,
2003. This act was designed to bolster the safety and security
of America's food supply, and will help with quick identification
and notification of food processors and other facilities involved
in any deliberate or accidental contamination of food.
"Food" is defined by reference to section 201(f) of the Federal Food,
Drug and Cosmetic Act as articles used for food or drink for man or
other animals, chewing gum, and articles used for components of any
such articles. Examples of food include; fish, fruits, vegetables,
animal feed, raw agricultural commodities, dairy products, eggs, food
and feed additives, dietary supplements and dietary ingredients, infant
formula, beverages including alcoholic beverages and bottled water,
bakery goods, snack foods, candy and canned food.
If the facility is located outside the United States, that facility
is called a "foreign facility", and it must designate a U.S. Agent.
UTi can register the foreign facility and act as the appointed U.S.
Agent. It is important for USA importers to reach out to their overseas
vendors to make sure that they have obtained a Registration Number
by the December 12, 2003 deadline. Imported products sent by an
unregistered vendor will be detained upon arrival into the United States.

communications. The agent acts as a communication link between the
FDA and the foreign facility for both emergency and routine communications.
